Actually, the judge did not. Since there was no grand jury indictment, Special Prosecutor Core issued a statutory indictment that included manslaughter. The judge didn't rule in favor of Zimmerman in the pre-trail dismissal hearing because she could not dismiss the 2nd degree murder charge, but keep the manslaughter charge. Judge Nelson is well aware that this grants a grounds for appeal. She hasn't yet hold in a charging conference how to deal with lesser included offenses.

Great example, that's patently false. You have no idea what you're talking about. Of course judges rule all the time that a defense is reasonable: it has to or it's not allowed at trial.
