Steve, Hauptmann wasn't required to take the stand in his own defense. He did so voluntarily.

If the trial were held today, Wilentz would have been scolded by the judge for misconduct. He might have been disbarred (I'd have disbarred him).The trial in Flemington was a rare case of prosecutorial misconduct. But Hauptmann was such a hateful defendant, owing largely to the anti-German atmosphere in the world owing to Hitler, that everything Wilentz did was overlooked.

Wilentz was, and remains, a disgrace to the legal profession.

    don't forget he was tripping over evidence as somebody once said. don't blame wilentz for hauptmanns bad showing on the stand.
