...Speculation, vs Fact (as I don't have any hard evidence that Edward Small had ever encountered the "singer" Tony Romano, prior to the litigation brought by the latter...nor have I seen a photo of Romano -- part of the AP story chose the expression "using his name and likeness" in reference to the lawsuit)...

...then, I would also suggest -- as you did, bobO -- that it was simply Coincidence. (If I pursue this to the point of an article, or at least as the Header Title for the section discussing it in the book, I'll be calling the piece "Kansas City Coincidental"....I can hear your groans all the way across the country, folx. ;) )

And, by the way...you got me curious, bobO, whether Small & his Associated Players and Producers (never mind United Artists!) could *possibly* have screwed up so badly as to forget the standard Copyright clause in the titles -- but no, there it is at 55 seconds into the Titles:

"The events and characters depicted in this photoplay are fictitious. Any similarity to actual persons, places or firms is purely coincidental."

But that clause doesn't prevent libel suits from those who imagine they've been maligned by the film's creators...

You can see it yourself -- and since I haven't watched KCC in a coupla-few years, I will probably join y'all: the Cleanest, Sharpest (and yes, Compleat at 99m32s) copy I've thus far found online is here...
