I don't want to overstate the situation, but the very future of your liberty is now at risk.
It's held in the hands of nine Supreme Court justices; perhaps more accurately by just one of them, Justice Anthony Kennedy.
The recently concluded oral arguments seemed to indicate that Kennedy and the court's four stalwart conservatives are going to vote to strike down the Affordable Care Act. As a result, many concerned citizens breathed sighs of relief.
They shouldn't. Because, frankly, it should have never come to this.
The very bedrock of our constitutional democracy, the whole ideal of enumerated federal powers, should not have its future decided by the mood of one Supreme Court justice.
But this is where we are. And it's scary. Because the latest polls show President Obama holding a double-digit lead over Mitt Romney. And Democratic Party operatives like my friend James Carville are absolutely drooling over the prospect of using the abolition of Obamacare as an issue to energize their base and take control of Congress in next fall's elections.
Don't take this wrong -- I don't carry water for the Republican or Democratic parties. I'm much more of a libertarian at heart.
But the fact remains that we will face not only an economic Armageddon if the Democrats recapture both the White House and Congress, but we'll also see an assault on our liberties like nothing seen since the first tea party in Boston.
With another four years, Obama will almost certainly be able to appoint at least two Supreme Court justices. Can you imagine the danger our personal liberty will face with a liberal majority on the Court?
But don't take it from me. A few months ago, at my annual New Orleans Investment Conference, Dr. Charles Krauthammer dissected the whole issue in the most entertaining and enlightening fashion I've ever seen.
