Stay denied for inmate Thomas D. Arthur

The 11th Circuit Court of Appeals in Atlanta has rejected a request
for a stay for Death Row inmate Thomas D. Arthur, who is scheduled to
be executed next week.

A three-judge panel ruled that Arthur's appeal challenging the
constitutionality of Alabama's execution procedure was moot because
the U.S. Supreme Court recently upheld a similar procedure used in

Arthur is scheduled to be executed July 31 for the 1982 murder of
Troy Wicker Jr. of Muscle Shoals. Arthur has another appeal pending
before the Alabama Supreme Court. That appeal requests access to
evidence for DNA testing and a stay in order to conduct the tests.
