Angela Weiss was a 12 year old girl who lived in Bastrop, Texas with her mother and younger siblings. 58 RR 36-37, 71.
On September 6, 1989, her mother had taken the other children to her boyfriend’s house and left Angela alone. 58 RR 38, 71-72. Angela’s boyfriend came over and brought a man with him that Angela did not know. She only knew that the man was Ron Moore’s cousin. 58 RR 39. After they left, Angela watched television and ate dinner on the couch in the living room, then fell asleep on the couch. 58 RR 41-42.
Angela was awakened by someone pushing her face into the couch, and she discovered that he had put something around her mouth and, later, her eyes. Thus, Angela could not see her assailant. 58 RR 42. The man repeatedly hit Angela on the back of her head with his fist and called her vulgar names. 58 RR 44. Further, he told Angela that he had a gun and that he would kill her. 58 RR 48. While hitting her, the man raped and sodomized Angela 58 RR 45. The man also forced Angela to perform oral sex on him. 58 RR 46. During that assault, Angela accidentally bit the man; consequently, the man began savagely biting her face and ear as he raped her again. 58 RR 47. Angela was never able to see her assailant because he kept some sort of a cloth over her eyes during the entire time he was assaulting her. 58 RR 48. There was a previously broken window in Angela’s home that appeared to be her assailant’s point of entry. 58 RR 65,90. After the man left, Angela wrapped herself in a blanket and ran to a neighbor’s house, who took her to her mother, where the police were called. 58 RR 49-50, 73. Angela was immediately taken to a hospital where a rape kit examination was performed on her. 58 RR 51, 75, 88. James Slaughter was initially a suspect in the aggravated rape of Angela Weiss. 58 RR 64, 90. Reed was not a suspect, since he did not even live in Bastrop County in 1989. However, his grandmother lived in Bastrop and Reed spent August and September, 1989 with her. 59 RR 18-19. Reed was linked to the aggravated rape of Angela Weiss by DNA evidence after the murder of Stacey Stites. 58 RR 92) The DNA from Angela’s rape kit examination was tested by the DPS laboratory, LabCorp, as well as Dr. Johnson, Reed’s expert. 60 RR 74-75, 80, 61 RR 10-11, CR 396-399. Reed could not be excluded as the perpetrator. 60 RR 78, 61 RR 12. The results indicated that only one person in the world population would have been expected to have the genetic profile of the semen from that rape. 61 RR 14-15. James Slaughter was specifically excluded by DNA analysis as having been the perpetrator. 58 RR 97, 60 RR 78. Reed is Ron Moore’s cousin. 58 RR 92. Reed was indicted for the aggravated sexual assault of Angela Weiss. That indictment is currently pending. 58 RR 97.
