Henderson County, Kentuck, native is scheduled to be executed tonight in Texas.

A jury found Cleve Foster guilty in 2004 of the rape and murder of a 28-year-old woman in Fort Worth.

Foster claims he is innocent.

He says it was his friend who actually killed the woman.

The friend was also convicted in the case, but he died in prison.

Foster is a 1981 graduate of Henderson County High School.

Foster's father refused to comment on camera, but he says Texas is doing the same thing it is accusing his son of doing.
