Only Canadian on U.S. death row to make clemency plea?

CALGARY—The lawyer for the only Canadian on death row in the U.S. says a plea for clemency may be the next step for his client.
Ronald Smith's lawyer Don Vernay says he's not surprised Montana politicians have blocked a bid to abolish the death penalty.
For the second time in four years a bill to repeal the death penalty failed to make it through the state legislature.
The 53-year old Smith is originally from Red Deer, Alberta.
He's been living on borrowed time since he was convicted in Montana in 1983 for shooting to death two cousins while he was high on drugs and alcohol.
Smith initially asked for the death sentence, but later had a change of heart.
The American Civil Liberties has filed a civil suit on Smith's behalf, arguing Montana's use of lethal injection is unconstitutionally cruel.
Smith's lawyers must decide whether to wait for the outcome of the suit, or petition Democratic Governor Brian Schweitzer for clemency.
