Man’s execution date in Dallas County murder case delayed to allow DNA testing

The execution of a man convicted in a Dallas County murder more than two decades ago has been delayed at the request of the district attorney’s office to allow further DNA testing.
Bobby Lee Hines was scheduled for lethal injection June 6 for the murder of 26-year-old Michelle Wendy Haupt at her Carrollton apartment. State District Judge Don Adams approved the delay Friday.
Court records do not provide details about the testing, and the district attorney’s office declined to comment through Jamille Bradfield, a spokeswoman for District Attorney Craig Watkins.
Hines’ attorney, Lydia Brandt, said in an email that testing involves DNA found on Haupt’s nail clippings.
“The DNA report recites that there is a one in two probability that Bobby Hines is a possible contributor,” Brandt wrote. “This is akin to saying one out of two people, who are randomly walking down the Dallas streets, is a ‘possible’ contributor. So the DNA test results do not prove Bobby Hines is the perpetrator.”
Brandt said that further testing is possible.
“The Dallas DA and the defense are in negotiation about further DNA testing,” she said.
During the trial, prosecutors said that in 1991, Hines used a pass key to ender Haupt’s apartment. Testimony showed that he choked her with speaker wire and stabbed her as many as 18 times. Hines’ roommate was an employee of the complex and had access to a pass key.
Haupt’s murder led to a 1994 settlement of more than $5 million between Haupt’s family and the complex and its management company. The family argued that Haupt would not have been killed had the complex installed a keyless deadbolt lock on the door.
