Delay Recovery Measures

Delay recovery measures are measures to recover delays. They are usually called acceleration measures. In the Standard Form, the delays refer to those not caused by the Contractor, essentially delays entitling to extension of time. Additional money is payable.

If the original Contract Period is reduced, then strictly the measures are not recovering the detays but are accelerating. This is for argument sake only. The difference may not be so important if both parties agree on the details of the recovery measures.

Delivery recovery or acceleration measures require agreement by both parties in order to get the additional money. Recovery without prior agreement may risk non-payment because who is responsible for the delay before recovery is often subject to disagreement.
