For my argument paper I am considering writing about the controversy involved with civil forfeiture. Civil forfeiture is the legal process in which police take assets from people suspected of being involved in illegal activities. Civil forfeiture is normally carried out through traffic stops where police can seize money, jewelry, the vehicle itself, or any other material item of value. In the court room the person who's property was seized isn’t even being charged with a crime, their property is being charged. Civil forfeiture is a controversial issue because police victimize people and seize their property only because they "suspect" the property is being used to commit criminal acts. Also, the controversy associated with civil forfeiture includes flawed judicial process, excessive punishment, the motivation of police misbehavior, the difficulty in challenging seizures, and the targeting of poor and politically weak people. This topic interests me because I saw a news article about this, and thought civil forfeiture was the craziest thing ever. In what way should any form of law enforcement be able to legally seize property just by suspecting illegal activity? I feel that civil forfeiture is the most absurd legal process out there, and it gives law enforcement way too much power. Although this is a highly controversial legal process, civil forfeiture is also seen as a highly effective way to fight and prevent illegal drug activity and organized crime. I agree that this is a great way for law enforcement to hinder the criminal activity that goes on all across the country, but I feel that law enforcement should have more than just a suspicion to legally seize property from anyone. To make civil forfeiture a more respectable way to combat illegal activity in the United States, law enforcement should be required to have some sort of proof that whatever possession they are seizing was involved in criminal activities or will be involved. The other topic I am considering for my argument paper is the drug testing of welfare recipients. I feel that this is a very viable topic to argue considering so many people are in support of this.
