The final topic I chose for my argument paper was the controversy associated with the flawed legal process of civil forfeiture. The first point I used in my argument is the fact that law enforcement officers can seize someone's possessions without that person ever being charged with a crime. This is wrong on so many levels because why should it be legal for a police officer to seize someone's money, vehicle, or house without charging the person with a crime? In a civil forfeiture case the only charges that are being dealt are civil charges against the property being seized. My second point of argument is how difficult the United States justice system makes for victims of civil forfeiture to reclaim their seized possessions. The way this country's justice system is structured tends to make battling civil forfeiture in court very unappealing to victims due to the cost of going to court. When someone chooses to go to court in attempt to get their seized possessions back in a civil forfeiture case, a lot of the times legal fees are more than what the lost property is even worth. With that being said, lower income families in America, who are affected by civil forfeiture, often times can not afford to get their possessions back through court. Another point of mine is that the way civil forfeiture laws are written and followed through with gives law enforcement officers nation wide the motivation to misbehave and misuse their power. As my research suggests with civil forfeiture laws the way they are, seizing property and/or assets from citizens suspected of a crime often becomes a profit seeking venture for police. When the police begin to forget about their real purpose of protecting the people of America, and begin worrying about profiting off of helpless citizens you know there is a problem. Obviously not every police officer in America is bad, but when laws give the police excess power they tend to be promoted to misuse this power. I feel the biggest challenge I am going to face writing this paper is properly explaining my research and supporting my evidence. WC-360
