Behan testimony / Joyce
Mon Aug 27, 2018 05:01

Joyce The right would have to reference from Behan's point of view.So since we both agree that it was the second from right, that would would eliminate Holliday as firing the first shot, since he was on the end/flank facing one of the Mclaury Bros.
Since Virgil was not the first to fire,By all accounts, that leaves Wyatt or Morgan either of which makes sense as they were the most prepared for a fight.

Based on Behan's testimony I think this is what is most plausible. If he was in the lot facing the Earp's the second man from right would have been Wyatt, which matches with Wyatt's testimony as to who fired the first shot.
One of the prosecution's mistakes was trying to place the Nickel Revolver in Doc"s hand at the opening shot. Behan not wanting to lie on the stand put it where he saw it in Wyatt or Morgan's hand.
Remember the prosecution devised the diagram and introduced it into evidence. The defense would object at the inquest as to positioning of participants but would save that for a trial if needed.
So to sum up ,By Behan's testimony, Holliday did not fire the first shot from the NP Revolver.
The question remains did Wyatt or Morgan fire it in response to Frank/Billy reaching for their weapons instead of "Throw up your hands" as ordered? Or did they just open fire in anger?

Pat, Disagreement is what keeps this board going. If we all agreed, what would be left to examine? However, opposing viewpoints should never bring about animosity, I am sure you agree, and sometimes... more

Nice exchange, folks. Just a waaaay out observation/perspective on "diagrams" and "weaponry". How does all this fit with the diagram by Wyatt/Flood exposed at the 2004 Gilchriese collection auction... more

That is why I pay little attention to the diagrams. They all seem to be flawed to some degree. I would rather go inch by inch over the testimony of people who were there at the time. Sometime a... more

Pat, There are at least two reasons why John Behan’s testimony does not support Wyatt’s statement of how the gunfight started. First, Behan testified that the Earp party fired the first two shots of... more

Why would you think Doc Holliday was always on the end? He never stopped moving. His first move, described by witnesses, was to approach Frank, right away. He jabbed Frank in the belly with his pistol ... more

Pat, You must be looking at the 1992 edition of Turner's book rather that the 1981 first edition. The diagrams on pages 100 and 101 of the book you are looking at are inaccurate and reflect Turner's... more

You are correct as to the edition I have. Looking at the diagram posted on page 145 I would think that if you count Virgil as Person 1 (position 8), then 2nd person from Behan's right right would... more

I can certainly see that it would be reasonable to count two over from Virgil - counting 1 for Virgil and 2 for Wyatt - and that you could come up with Wyatt as the second man from the right.... more
